According to the Financial Post Sleep Country is suing Sears in the Federal Court of Canada alleging that Sears' new mattress slogan infringes on Sleep Country's trademarked catch-phrase.

Sears has its back up against the wall again. The troubled retailer has just received notice from a judge that Sears’ marketing slogan “there is no reason to buy a mattress anywhere else”  is too close to Sleep Country’s tried a true slogan “Why Buy a Mattress anywhere else?”

According to the Financial Post  Sleep Country is suing Sears in the Federal Court of Canada alleging that Sears’ new mattress slogan infringes on Sleep Country’s trademarked catch-phrase.

Currently, a Federal court has not made a ruling on  Sleep Country’s claim, however, a temporary ban has been established that orders Sears to refrain from using their mattress slogan until a decision has been made.

As anyone that’s ever watched Canadian TV or radio has certainly heard Christine McGee pitch Sleep Country’s famous slogan.

The Financial Post highlights that a full-blown trial will likely not occur for the next 18 – 24 months.
